Welcome to Redefining Wellness by Heidi Anne Diamond, BScN, Clinical EFT Practitioner.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THIS WEBSITE.
Heidi Anne Diamond, operating as Redefining Wellness (“Redefining Wellness”), owns and operates this website and any other web services or products offered by Redefining Wellness now or in the future, including, but not limited to, its related social media platforms. By accessing, using, downloading, viewing this website, or any of its services, products, programs, resources, or Content (defined below), (collectively, the “Site”), you hereby consent and agree to these terms and conditions (“Terms of Use”). The Terms of Use and Privacy Policy (please see here) (collectively, the “Terms”) govern your use of the Site, and other free materials and resources provided by the Site, and any other services or products made available on this Site (collectively, the “Services”). These Terms constitute a legally binding agreement made by and between Heidi Anne Diamond (operating as Redefining Wellness) and the user of this Site (personally and, if applicable, on behalf of the entity for whom you are using the Site; collectively, “you”).

Eligibility and Account Information
Eligibility: To use the Site, you must be at least 18 years of age and legally capable of entering into binding contracts. While Redefining Wellness offers services to clients of all ages, only individuals 18 years or older may create an account and agree to these Terms. If you are under 18 and wish to use Redefining Wellness services, your parent or legal guardian must create an account, agree to these Terms on your behalf, and supervise your use of the services. By using the Site on behalf of a minor or any other third party, you represent that you are an authorized representative of that party and that your use of the Site constitutes that party’s acceptance of these Terms. If you have been previously prohibited from accessing the Site, you are not permitted to do so.
Account Information: If you create an account, you must provide true, accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account and password. You accept responsibility for all activities that occur under your account. Your account is non-transferable and may not be sold, combined, or otherwise shared with any other person. Any violation of these Terms, including failure to maintain accurate account information, may result in immediate termination of your account at Redefining Wellness’s sole discretion. When you register with Redefining Wellness and/or this Site, you expressly consent to receive notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, and other correspondence from Redefining Wellness.
Feedback: If you send comments or suggestions about the Site to Redefining Wellness, including but not limited to notes, text, drawings, images, designs, or computer programs, such submissions shall become and remain the sole property of Redefining Wellness. No submission shall be subject to any obligation of confidence on Redefining Wellness’s part. Redefining Wellness shall exclusively own all rights to (including intellectual property rights) and shall be entitled to unrestricted use, publication, and dissemination of all such submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
Content on the Site (Including Intellectual Property Rights)
Intellectual Property Rights: You agree that the Site itself, as well as all content, photographs, sound or videos, media, images, formulas, graphics, webinars, training materials, products, podcasts, services and/or other information and materials, and selection and arrangements thereof is copyrighted work under the Copyright Act of Canada, applicable international copyright laws, and copyright laws of other jurisdictions as relevant, and is the property of or licensed by Redefining Wellness, made available on the Site or any information, materials, and content transferred via a downloadable file or link by Redefining Wellness or other third parties (collectively the “Content”). Redefining Wellness’s collection, use, and disclosure of personal information is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws, as well as relevant international data protection regulations where applicable to international clients.
Subject to your compliance with these Terms, Redefining Wellness hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access, view, and use the Site solely for your personal purposes and non-commercial use, and as otherwise intended. Redefining Wellness reserves the right to monitor the Services and Content for the purpose of determining that your usage complies with these Terms.
You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or Content on the Site in whole or in part, other than as necessary for your own personal non-commercial use, without Redefining Wellness’s written consent. This Site and its Content are currently only available in English. By using this Site, you acknowledge and agree that all communications and transactions with Redefining Wellness will be conducted in English.

Any disputes arising from your use of this Site, or its Content will be governed by and construed in accordance with the laws of Edmonton, Canada, without giving effect to any principles of conflicts of law. However, Redefining Wellness acknowledges that its international clients may have additional rights under their local laws, and it will respect those rights to the extent required by applicable law.
User Conduct and Prohibited Activities
Prohibited Conduct: You agree not to copy or imitate the appearance, design, or style of the Redefining Wellness Site or any Content. The technology and software underlying the Site, and the Services are the property of Redefining Wellness, its affiliates, and/or its business partners.
You agree that you will not use the Site or its Content to take any of the following actions:
• Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of Redefining Wellness, Heidi Anne Diamond, or any other person or entity;
• Use the Service, Site, or Products commercially without express written permission from Redefining Wellness;
• Reverse engineer, decompile, tamper with, or disassemble the technology used to provide the Services, Site, or Products (except as and only to the extent any foregoing restriction is prohibited by a non-waivable provision of applicable law);
• Interfere with or damage the Services, Site, Products, or underlying technology;
• Impersonate or misrepresent your identity or affiliation;

Use of the Site is subject to existing laws and legal processes of Canada and other applicable jurisdictions. Nothing contained in these Terms will limit Redefining Wellness’s right to comply with governmental, court, and law-enforcement requests or requirements relating to your use of the Site.
Redefining Wellness reserves the right to terminate or suspend your access to all or part of the Site, without notice, for any conduct that Heidi Anne Diamond, in her sole discretion, believes to be in violation of any applicable law, these Terms, or is harmful to the interests of another user, a third-party, or Redefining Wellness.

The following provides examples of the type of information that Redefining Wellness collects from you, how this information is used, and Redefining Wellness’s interest in using that information.
Redefining Wellness collects the following types of information:
• Account Registration: Redefining Wellness collects your name, email address and contact information when you create an account to use Redefining Wellness Products and/or Services. Redefining Wellness has a legitimate interest in providing information to you to provide the Products and/or Services.
• Subscriber Information: Redefining Wellness collects the name, email and contact information of subscribers and their affiliated organizations with whom Redefining Wellness may interact. Redefining Wellness has a legitimate interest in contacting subscribers and communicating with them concerning normal administration.
• Cookies and First-Party Tracking: Redefining Wellness uses cookies and clear GIFs. “Cookies” are small pieces of information that a website sends to a computer’s hard drive while a web site is viewed. Redefining Wellness has a legitimate interest in making the website operate efficiently.

• Payments: Redefining Wellness collects your name, billing address, shipping address, e-mail address, phone number, and payment information when you subscribe to Products and/or Services. This information is used to perform the contract to provide you with Products and/or Services.
• Website Interactions: Redefining Wellness uses technology to monitor how you interact with the website. This may include which links you click on, or information that you type into online forms. This may also include information about your device or browser. Redefining Wellness has a legitimate interest in understanding how you interact with the website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful. • Web Logs: Redefining Wellness collects information, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the Internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors. Although the sections above describe the primary purpose in collecting your information, in many situations Redefining Wellness has more than one purpose. For example, if you book a wellness consultation, Redefining Wellness will collect your information to perform the contract with you, but your information is also collected because Redefining Wellness has a legitimate interest in maintaining your information after your consultation is complete to quickly and easily respond to any follow-up questions about your wellness plan. As a result, the collection and processing of your information is based in different contexts upon your consent, the need to perform a contract, obligations under law, and/or Redefining Wellness’s legitimate interest in conducting business.
The use and processing of your information are based on one or more of the following legal grounds:
• Your consent
• The necessity to perform contractual obligations
• Compliance with legal obligations
• Redefining Wellness’s legitimate interests in conducting business, improving services, and protecting legal rights
Specific Wellness Service
Some of Redefining Wellness’s services may involve the collection and processing of more sensitive personal information, such as detailed health information or wellness goals. This information is used exclusively to provide personalized wellness services, including but not limited to nutritional advice, fitness plans, or holistic health consultations. Redefining Wellness processes this sensitive information only with your explicit consent and in accordance with applicable health information privacy laws.
Sharing of Information
Redefining Wellness respects your privacy and is committed to protecting your personal information. Redefining Wellness does not sell, rent, or trade your personal information to third parties for their marketing purposes.
However, Redefining Wellness may share your information in the following circumstances:

If required by law, upon request, Redefining Wellness will grant you reasonable access to the personal information that it has about you. • Changes To Your Personal Information: Redefining Wellness relies on you to update and correct your personal information. Note that historical information in backup files may be kept as permitted by law. If the website does not permit you to update or correct certain information, contact Redefining Wellness at the address described below.
• Deletion Of Your Personal Information: Typically, Redefining Wellness retains your personal information for the period necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law. These rights are provided under the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. Note: Please be aware that exercising some of these rights (such as deletion or withdrawing consent) may impact Redefining Wellness’s ability to provide services to you.
How your Personal Information is Protected
No method of transmission over the Internet, or method of electronic storage, is fully secure. While Redefining Wellness uses reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, Redefining Wellness cannot guarantee the absolute security of your personal information.
The Redefining Wellness website permits you to create an account. When you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify Redefining Wellness of any unauthorized use of your password or account.
Redefining Wellness implements the following measures to protect your personal information:
• Encryption: Redefining Wellness uses industry-standard encryption technologies when transferring and receiving personal data.
• Secure Storage: All personal information is stored on secure servers behind firewalls.

Although Redefining Wellness is not based in California, Heidi Anne Diamond respects the rights of California residents under the California Consumer Privacy Act (CCPA) and California Online Privacy Protection Act (CalOPPA). Canada’s Anti-Spam Legislation (CASL)
Redefining Wellness complies with Canada’s Anti-Spam Legislation (CASL). Heidi Anne Diamond only sends electronic communications with your consent, which can be implied or express. Every email Redefining Wellness sends includes an unsubscribe mechanism, allowing you to opt out of receiving future electronic communications at any time. Please note that even if you unsubscribe from promotional email messages, Redefining Wellness may still need to contact you with important transactional information about your account or services.
Children’s Privacy
Redefining Wellness does not knowingly collect or solicit personal information from anyone under the age of 13 (or under the age of 16 in the European Economic Area). If you are under 13 (or under 16 in the EEA), please do not attempt to register for Redefining Wellness services or send any personal information about yourself to Heidi Anne Diamond.
If Heidi Anne Diamond learns that Redefining Wellness has collected personal information from a child under the relevant age without parental consent, she will delete that information as quickly as possible. The primary service is conducting one-on-one EFT sessions via online platforms, with Zoom being the preferred method of delivery. While Zoom is the preferred platform, Heidi Anne Diamond is flexible and can accommodate other online platforms upon request.

Refund Policy:

Rescheduling and Cancellation Policy:
Please note the following policies regarding rescheduling and cancellations:
• A 24-hour cancellation policy is in effect for all sessions.
• If you need to reschedule or cancel a session, please provide at least 24 hours’ notice.
• If you fail to provide 24 hours’ notice before cancelling or rescheduling, your prepaid session will be considered “used,” and no refund or credit will be issued.
• If you are late for a session, the session will still end at the scheduled time and will not run over into the next person’s session.
• Heidi Anne Diamond, operating as Redefining Wellness, reserves the right to refuse or terminate a session if the client is suspected of being under the influence of mood-altering substances. In such cases, the prepaid session will be considered “used,” with no refund or credit issued.

Privacy and Security Measures for Online Sessions

b) You agree to participate in sessions from a private location where others cannot overhear the conversation.
c) Recording of sessions by either party is strictly prohibited unless mutually agreed upon in writing between you and Heidi Anne Diamond.
d) You should ensure that your device has up-to-date antivirus software and security patches.
e) Redefining Wellness complies with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and strives to meet international data protection standards for clients outside of Canada.
Emergency Procedures for Distance Clients
a) As part of the required client intake form that you complete when booking your first appointment with Redefining Wellness, you will provide the name and contact information of a local emergency contact person. There will also be an option to provide a secondary local emergency contact person. This information is essential for telehealth services and must be kept up to date.
b) You agree to inform Heidi Anne Diamond, operating as Redefining Wellness, of your location at the start of each session.
c) In case of an emergency during a session, Heidi Anne Diamond will:
• Attempt to re-establish contact;
• Contact your emergency person if unable to reach you;
• If necessary, contact local emergency services.
d) You understand that telehealth services may not be appropriate if you are experiencing an acute crisis or having thoughts of harming yourself or others. In such cases, Heidi Anne Diamond may recommend alternative in-person services or immediate emergency care.

Permission for Recording Sessions
By engaging in services with Redefining Wellness, you acknowledge and agree to the following regarding session recordings:
a) Heidi Anne Diamond, operating as Redefining Wellness, may record live calls, classes, workshops, or individual sessions for quality assurance and educational purposes.
b) You will always be notified before a recording begins, typically through the video conferencing platform’s built-in notification system.
c) Your verbal consent will be requested at the start of any recorded session.
d) You have the right to decline being recorded at any time without it affecting the quality of service you receive from Heidi Anne Diamond.
Use of Recordings for Educational Purposes
a) Recordings may be used for the following educational purposes:
• Review and improvement of Redefining Wellness services;
• Training for Heidi Anne Diamond’s professional development;
• Sharing select, anonymized portions of recordings for educational purposes with future clients, only with explicit written permission from the recorded client.
b) Any use of recordings will prioritize client confidentiality. Identifying information will be removed or obscured unless explicit written permission is granted.
c) Recordings will never be used for marketing or promotional purposes without separate, explicit written consent.
d) All recordings will be stored securely and accessed only by Heidi Anne Diamond, operating as Redefining Wellness, for the purposes stated above, unless otherwise agreed upon in writing.
Client Rights Regarding Recordings
As a client of Redefining Wellness, you have the following rights regarding session recordings:
a) The right to request a copy of any recording in which you appear.

By agreeing to these terms, you certify that you are over 18 years of age, or that you are the parent or legal guardian of a client under 18 years of age. You grant Heidi Anne Diamond, operating as Redefining Wellness, permission to record and use video or photographic content as specified above.
You release Heidi Anne Diamond and Redefining Wellness from any claims that may arise from the use of these recordings within the stated purposes, understanding that this release applies to both adult clients and minor clients (through their parent/guardian’s consent).
Redefining Wellness is committed to handling all recordings in accordance with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any additional protections required for minors under Canadian law. • Confidentiality: All client information is kept strictly confidential, except in cases where disclosure is required by law or to prevent harm.
• Informed Consent: Clients are fully informed about the nature of EFT, potential risks and benefits, and their rights before beginning treatment.
• Client Welfare: The well-being and best interests of the client are always the primary focus of the therapeutic relationship.
• Professional Boundaries: Clear and appropriate boundaries are maintained in all client relationships.
• Continuing Education: Heidi is committed to ongoing professional development to stay current with the latest research and best practices in EFT and holistic wellness.
• Scope of Competence: Heidi practices within the boundaries of her training and expertise, referring clients to other professionals when necessary.
• Cultural Sensitivity: Respect for diverse backgrounds, beliefs, and values is maintained in all client interactions.

All concerns will be addressed promptly and professionally, in accordance with the ethical standards of EFT International and other relevant professional bodies.
Disputes
Subject to applicable Canadian law, you and Heidi Anne Diamond, operating as Redefining Wellness, agree that any dispute that has arisen or may arise between us relating in any way to your use of or access to the Services or Site, any breach, enforcement, or termination of these Terms, or otherwise relating to Redefining Wellness in any way will be resolved in accordance with the provisions set forth in this Section.
Informal Resolution
If you have any dispute with Redefining Wellness, you agree that before taking any formal action, you will contact Heidi Anne Diamond at redefiningwellness@gmail.com. Please provide a brief, written description of the dispute and your contact information, as well as any relevant receipts of your booking(s) or appointments (including your username, if your dispute relates to an account). Allow sixty (60) days to pass, during which Heidi Anne Diamond will attempt to reach an amicable resolution of the issue.
Arbitration
These Terms and each of its parts evidence a transaction involving interstate commerce, and the Arbitration Act of Alberta applies in all cases and governs the interpretation and enforcement of the arbitration rules and arbitration proceedings. Any Covered Matters must be asserted individually in binding arbitration administered by the ADR Institute of Canada (“ADRIC”) in accordance with its Commercial Arbitration Rules and Mediation Procedures (including, without limitation, utilizing desk, phone or video conference proceedings where appropriate and permitted to mitigate costs of travel). The arbitrator shall not conduct any form of class or collective arbitration nor join or consolidate claims by or for individuals. The arbitrator, and not any federal, provincial, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of these Terms, including, but not limited to, any claim that all or any part of these Terms is void or voidable or a particular claim is subject to arbitration. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Award
For matters where the relief sought is over $5,000 CAD, the arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. The arbitrator will decide the substance of all claims in accordance with applicable law, including recognized principles of equity, and will honor all claims of privilege recognized by law. The arbitrator shall not be bound by rulings in prior arbitrations involving different users but is bound by rulings in prior arbitrations involving the same Redefining Wellness user to the extent required by applicable law. The arbitrator’s award shall be final and binding and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S). ANY RELIEF AWARDED CANNOT AFFECT OTHER USERS.
Exceptions
There are only two exceptions to this arbitration agreement:
First, if a party reasonably believes that the other party has in any manner infringed or threatened to infringe the intellectual property rights of the other party, the party who owns the intellectual property rights may seek injunctive or other appropriate interim relief in any court of competent jurisdiction.
Second, any claim of $500 CAD or less may, at the option of the claiming party, be resolved in small claims court within Canada, if the claim and the parties are within the jurisdiction of the small claims court and so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis.
Costs of Arbitration
Payment of all filing, administration, and arbitrator fees will be governed by the ADR Institute of Canada’s rules, unless otherwise stated in this agreement to arbitrate. If the value of the relief sought is $5,000 CAD or less, at your request, Heidi Anne Diamond, operating as Redefining Wellness, will reimburse you for all filing, administration, and arbitrator fees associated with the arbitration following the earlier of the arbitrator’s decision or settlement. In the event the arbitrator determines the claim(s) you assert in the arbitration to be frivolous, Heidi Anne Diamond is relieved of her obligation to reimburse you for any fees associated with the arbitration.
Future Amendments to the Agreement to Arbitrate
Notwithstanding any provision in the Terms to the contrary, you and Heidi Anne Diamond agree that if she makes any amendment to this agreement to arbitrate in the future, that amendment shall not apply to any claim that was filed in a legal proceeding against Redefining Wellness prior to the effective date of the amendment. The amendment shall apply to all other disputes or claims governed by the agreement to arbitrate that have arisen or may arise between you and Redefining Wellness. If you do not agree to these amended terms, you may close your account within thirty (30) days of the posting or notification and you will not be bound by the amended terms.
Judicial Forum for Legal Disputes
Unless you and Heidi Anne Diamond agree otherwise, in the event that the agreement to arbitrate above is found not to apply to you or to a particular claim or dispute, either as a result of your decision to opt out of the agreement to arbitrate, as a result of a decision by the arbitrator or a court order or because you have chosen to file an eligible lawsuit in small claims court, you agree that any claim or dispute that has arisen or may arise between you and Redefining Wellness must be resolved exclusively by a provincial or federal court located in Edmonton, Alberta. You and Heidi Anne Diamond agree to submit to the personal jurisdiction of the courts located within Edmonton, Alberta for the purpose of litigating all such claims or disputes.
Opt-Out
If you are a new Redefining Wellness user, you can choose to reject the agreement to arbitrate provision (“OPT-OUT”) by emailing Heidi Anne Diamond an OPT-OUT notice to redefiningwellness@gmail.com (“OPT-OUT NOTICE”). The Opt-Out notice must be received no later than thirty (30) days after the date you accept the Terms of Service for the first time. If you are not a new Redefining Wellness user, you have until thirty (30) days after the posting of the current Terms of Service (August 17th, 2024) to submit an arbitration OPT-OUT notice.
Procedure:
In order to opt-out, you must email your name, address (including street address, city, province, and postal code), and email address(es) associated with your Account(s) to which the opt-out applies and an unaltered digital image of a valid government-issued ID which matches the name on your account to: redefiningwellness@gmail.com. This procedure is the only way you can opt out of the agreement to arbitrate. If you opt out of the agreement to arbitrate, all other parts of the agreement and its Disputes Section will continue to apply to you. Opting out of this agreement to arbitrate has no effect on any previous, other, or future arbitration agreements that you may have with Redefining Wellness.
Waiver
By agreeing to these terms, you hereby irrevocably waive any right you may have to a court trial (other than small claims court as provided above) or to serve as a representative, as a private attorney general, or in any other representative capacity, or to participate as a member of a class of claimants, in any lawsuit, arbitration or other proceeding filed against Heidi Anne Diamond and/or related third parties.
Indemnification
You hereby agree to indemnify, defend and hold Heidi Anne Diamond, operating as Redefining Wellness, and all of her officers, directors, managers, members, employees, agents, information providers, affiliates, partners, and licensors (“Redefining Wellness Party,” or collectively, the “Redefining Wellness Parties”) harmless from and against any and all liability, claims, damages, losses, costs, and expenses, including attorneys’ fees, incurred by any Redefining Wellness Party arising from, related to, or in connection with (a) a violation of any provision of these Terms by you; or (b) arising from, related to, or connected with your violation of the rights of Redefining Wellness or any other person or entity. Heidi Anne Diamond may, in her sole and absolute discretion, control the disposition of any such claim at your sole cost and expense. You may not settle any such claim without her express written consent. This defense and indemnification obligation is intended to extend to the fullest extent permitted by law and will survive these Terms and your use of the Site.

EFT vs CBT: Effects on Psychological and Physiological Parameters in Indian Adults
The study evaluated the efficacy of Emotional Freedom Technique (EFT) and Cognitive Behavioral Therapy (CBT) in treating stress, anxiety, depression, short-term memory loss, psychophysiological coherence, and heart rate in Indian adults.
The research involved 14 participants randomly assigned to 8 weekly sessions of either EFT or CBT. Measurements were taken at multiple points including pre-intervention, during treatment (3, 5, and 8 weeks), and at follow-ups (1 month and 6 months). The study found that both interventions produced significant reductions in stress, anxiety, and depressive symptoms, while also improving short-term memory, psychophysiological coherence, and heart rate. Notably, the CBT group showed significant improvements immediately post-intervention, while the EFT group demonstrated a delayed effect with significant reductions in symptoms at the 1-month and 6-month follow-ups.
